These Terms of Service ("Terms") are a binding agreement between you and FamBam Labs LLC, a Texas limited liability company ("FamBam," "we," "us," or "our"). They govern your access to and use of the FamBam mobile app, the website at fambam.app, and any related services (together, the "Service").
Please read these Terms carefully. Section 13 contains a binding arbitration clause and class action waiver that affect your legal rights.
1. Acceptance of Terms
By creating a FamBam account, downloading or using the FamBam app, or otherwise accessing the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Accounts
2.1 Age Requirement
You must be at least 13 years old to create your own FamBam account. Users between 13 and 17 may create an account with the consent of a parent or legal guardian, and we encourage parents to supervise their teen's use of the Service.
Children under 13 may use FamBam only as a managed sub-account added by a parent or legal guardian through their own FamBam account. Children under 13 cannot create their own account, cannot sign up directly, and do not receive independent login credentials. See our Privacy Policy for details on how we handle children's data under COPPA.
2.2 Your Account
You are responsible for maintaining the security of your account credentials and for all activity that happens under your account. Notify us immediately at support@fambam.app if you suspect unauthorized access. You must provide accurate account information and keep it up to date.
2.3 Household Roles
FamBam uses role-based household membership: Captain, Co-Captain, Member, Caregiver, Teen, and Kid. The Captain is the household administrator and has additional responsibilities, including managing members, adding children, and providing parental consent for children under 13.
3. The Service
FamBam provides tools for family and household organization, including shared calendars, task and chore tracking, meal planning, shopping lists, document and photo storage, and an AI assistant called "Bam." Features and availability may change over time.
4. Subscriptions and Billing
4.1 Free and Paid Plans
FamBam offers a free tier and one or more paid subscription tiers. The specific features, price, and billing frequency of each tier are disclosed at the point of purchase and may change over time. We will give you reasonable advance notice of any price change affecting your existing subscription.
4.2 Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period unless you cancel before the next renewal date. Renewal charges are processed by Apple (iOS), Google (Android), or another billing provider as applicable.
4.3 Cancellation and Refunds
You can cancel your subscription at any time through your device's App Store or Play Store subscription settings. Cancellations take effect at the end of the current billing period, and you retain access to paid features until then. Except where required by law, subscription payments are non-refundable. Refund requests are handled by Apple or Google according to their policies.
4.4 Free Trials
If we offer a free trial, you will be informed of its duration at sign-up. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Upload or share content that is illegal, harmful, harassing, defamatory, fraudulent, infringing, or that violates the privacy or rights of others
- Attempt to reverse-engineer, decompile, or extract the source code of the app (except where permitted by law)
- Interfere with or disrupt the Service, its servers, or other users
- Use the Service to send spam or unsolicited messages
- Scrape, crawl, or harvest data from the Service using automated means
- Circumvent any access controls, rate limits, or security features
- Impersonate another person or misrepresent your affiliation with any person or household
- Use the Service to create a competing product
We may suspend or terminate accounts that violate these rules.
6. Your Content
6.1 Ownership
You retain ownership of the content you create or upload to FamBam — your calendars, tasks, documents, photos, notes, and messages (collectively, "User Content").
6.2 License to FamBam
To operate the Service, you grant FamBam a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes like resizing or format conversion), display, and transmit your User Content solely as necessary to provide the Service to you and your household. This license ends when you delete your content or your account, except to the extent we need to retain copies for backup, legal, or fraud-prevention purposes.
6.3 Your Responsibility
You represent that you have all necessary rights to the content you upload and that sharing it with FamBam and your household members does not violate any third party's rights. You are responsible for your User Content.
6.4 Household Sharing
Content you upload to a household is visible to other members of that household according to their roles. Think carefully before uploading sensitive information to a shared household.
7. AI Features Disclaimer
FamBam includes AI-powered features, including the Bam assistant, daily briefings, document understanding, image generation, and email analysis. These features use third-party AI models (Anthropic Claude and Google Gemini) and are subject to important limitations:
- AI output is not professional advice. Bam is not a lawyer, doctor, financial advisor, therapist, accountant, or licensed professional. Do not rely on AI output for medical, legal, financial, or safety-critical decisions.
- AI output may be wrong. Language models can produce inaccurate, outdated, or fabricated information. Always verify important details from authoritative sources.
- AI-generated images are for entertainment. Generated images (e.g., event invitations, meal illustrations) are decorative and may not accurately represent real people, places, or food.
- Use of AI features is optional. You can avoid AI features by not using them.
FamBam is not liable for any decision you make based on AI output.
8. Intellectual Property
8.1 FamBam's Rights
The FamBam app, website, logo, name, and all related software, designs, and documentation are owned by FamBam Labs LLC and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written permission.
8.2 Feedback
If you send us suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
9. Third-Party Services
FamBam integrates with third-party services (Apple, Google, Anthropic, Sentry, SendGrid, RevenueCat, and others). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them beyond their role in powering FamBam features.
10. Termination
10.1 By You
You may stop using the Service or delete your account at any time through the app.
10.2 By Us
We may suspend or terminate your account if you violate these Terms, if we are required to by law, or if continued operation of your account poses a security, legal, or fraud risk to FamBam or other users. Where practical, we will give you notice and an opportunity to cure a violation before terminating.
10.3 Effect of Termination
Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, FamBam disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted or error-free operation.
FamBam does not warrant that the Service will meet your requirements, that AI output will be accurate, that data will never be lost, or that the Service will be free from bugs, security vulnerabilities, or interruptions.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAMBAM AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid FamBam in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the smallest extent permitted by law.
13. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights and requires most disputes to be resolved through individual binding arbitration rather than in court.
13.1 Informal Resolution
Before filing a formal claim, you agree to first try to resolve the dispute informally by contacting us at support@fambam.app. We will try in good faith to resolve your concern within 60 days.
13.2 Binding Arbitration
If informal resolution fails, you and FamBam agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in English. The seat of arbitration will be Travis County, Texas, though in-person appearances are generally not required for consumer claims under $25,000.
The arbitrator — not a court — will decide all issues, including the scope and enforceability of this arbitration agreement.
13.3 Class Action Waiver
You and FamBam agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found unenforceable, then the entirety of this Section 13 is null and void.
13.4 Exceptions
Either party may bring an individual claim in small claims court in Travis County, Texas, if it qualifies. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.
13.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to support@fambam.app within 30 days of first accepting these Terms, stating your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, and by applicable U.S. federal law (including the Federal Arbitration Act for Section 13). Subject to Section 13, the exclusive venue for any claims not subject to arbitration is the state and federal courts located in Travis County, Texas.
15. Indemnification
You agree to indemnify and hold harmless FamBam Labs LLC and its officers, members, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your User Content, or your misuse of the Service.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Continuing to use the Service after an update means you accept the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may delete your account.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and FamBam about the Service.
- Severability. If any provision is found unenforceable, the rest of the Terms remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- No agency. Nothing in these Terms creates any agency, partnership, or employment relationship.
